Description of services
ASV Ltd provides an online platform for creating animated sales videos for businesses. Our services include creating a script, storyboarding, voiceover, animation, and final delivery of the completed video. We may modify or discontinue any aspect of our services at any time without notice.
Quality assurance
ASV Ltd is committed to providing high-quality services to our customers. We have a strict quality assurance process in place to ensure that all videos we create meet our high standards. This process includes multiple rounds of review and revision to ensure that the final video meets your specifications and exceeds your expectations.
If you have any concerns about the quality of the video we create for you, please let us know as soon as possible so that we can address the issue promptly. We are committed to resolving any issues that arise and ensuring your complete satisfaction with our services.
Please note that our quality assurance process does not guarantee the success of your business or the effectiveness of the video in achieving your goals. While we will work with you to create a video that meets your specifications, the ultimate success of the video will depend on a variety of factors outside of our control.
By using our services, you acknowledge and agree that ASV Ltd is not responsible for the ultimate success or failure of your business or the effectiveness of the video in achieving your goals.
Project deadlines
ASV Ltd strives to provide timely and efficient services to our customers. However, the timeline for completing a video project can vary depending on the complexity of the project and the amount of information and feedback provided by the customer.
Our whiteboard and explainer videos typically require 4+ weeks for completion, while our premium videos can take 8+ weeks. Please note that these timelines are estimates and the final timeline may vary depending on the specific details of your project.
We understand that some projects may require faster turnaround times, and rush jobs may be available for an additional fee. If you require a rush job, please speak with your project manager to discuss the options available to you.
While we strive to complete all projects as quickly as possible, our priority is always to deliver a high-quality product that meets your specifications and exceeds your expectations. As such, we ask that our customers remain flexible with project timelines to ensure that we have sufficient time to deliver the best possible video product.
By using our services, you acknowledge and agree that the timeline for completing your project may vary and that ASV Ltd cannot be held responsible for any delays that may occur due to circumstances beyond our control. We will do our best to keep you informed of any delays and work with you to complete your project in a timely manner.
Revisions
ASV Ltd understands that revisions may be necessary to ensure that your video project meets your expectations. We offer two rounds of revisions as part of our standard service package.
After we have completed the initial draft of your video, we will send it to you for review and feedback. You will have the opportunity to provide us with your comments and suggestions for revisions. We will then make the necessary changes and send you a revised version of the video for your review.
We offer a second round of revisions to ensure that the final video meets your expectations. Please note that any additional revisions beyond the two rounds included in our standard service package may incur additional fees.
It is important to note that the scope of revisions must be limited to the original project specifications. Any significant changes to the project scope may require additional fees and a new agreement.
By using our services, you acknowledge and agree that the two rounds of revisions included in our standard service package are sufficient to make minor adjustments and changes to the video. Any additional revisions beyond the two rounds may incur additional fees and may impact the timeline for completing the project.
Payments
All prices are in United States Dollars (USD). Payment is due in full prior to commencement of services. ASV Ltd accepts payment through credit card, via Stripe or bank transfer. Any fees associated with payment (such as wire transfer fees) are the responsibility of the customer.
Refunds
ASV Ltd offers a 100% satisfaction guarantee. If you are not completely satisfied with the video we create for you, we will make revisions until you are satisfied. If you are still not satisfied after revisions, you can request a refund by contacting us.
Intellectual property
ASV Ltd recognizes that the intellectual property rights in the videos we create belong to our clients. Upon completion of the video project and receipt of full payment, all intellectual property rights associated with the video will be transferred to the client.
Please note that ASV Ltd retains the right to use any video content created for our portfolio, promotional materials, or marketing efforts. However, we will not use any of the content for commercial purposes without the client's express written consent.
By using our services, you acknowledge and agree that ASV Ltd does not claim any ownership rights over the video content created for you. You also acknowledge and agree that you are solely responsible for obtaining any necessary permissions or licenses for any third-party content used in the video.
Please note that any breaches of intellectual property rights will be the responsibility of the client, and ASV Ltd cannot be held liable for any infringements.
Confidentiality
ASV Ltd will keep all information you provide to us confidential. We will not disclose any information you provide to us to any third party without your consent, except as required by law.
Limitation of liability
ASV Ltd will not be liable for any damages of any kind arising from the use of our services, including but not limited to direct, indirect, incidental, punitive, and consequential damages. Our liability to you will be limited to the amount of fees paid by you to ASV Ltd.
Indemnification
You agree to indemnify, defend, and hold harmless ASV Ltd, its officers, directors, employees, and agents from any and all claims, damages, expenses, and liabilities arising out of or in connection with your use of our services.
Termination
ASV Ltd reserves the right to terminate our services to you at any time, without prior notice, if we find that you have violated any of the terms of our agreement or any applicable laws or regulations. You may also terminate our services at any time by providing us with written notice. Upon termination, any outstanding fees owed to us become immediately due and payable.
Governing law and jurisdiction
These Terms and the validity, construction, and performance thereof will be governed in all respects by the laws of New Zealand, without regard to its choice of law provisions.
By using this site and our services you agree that any action that arises from the use of this site or our services may only be brought in the courts of New Zealand. You consent that for yourself and in respect of your property to this jurisdiction and waive any objection to the action proceeding in such a venue, including if it is inconvenient for you.
You also consent that in the event ASV Ltd takes any legal action against you for violating this ‘terms of use’ agreement that you shall be liable for any legal fees that ASV Ltd incurs.
Changes to terms
ASV Ltd may modify these Terms at any time without notice. Your continued use of our services after any such modifications will constitute your acceptance of the modified Terms.
Entire agreement
These Terms constitute the entire agreement between you and ASV Ltd with respect to your use of our services. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
